1. General provisions
1.1. Services are provided by CyberForge sp. z o.o., a company organized under the laws of Poland — hereinafter referred to as the “Provider”.
1.2. These Terms set out the rules for: a) services provided electronically on the cyberforge.agency website (section 2), b) concluding and performing contracts for cybersecurity services — training, assessment of the software development process and implementation of security practices (sections 3–8).
1.3. The services in sections 3–8 are intended for businesses. Consumers and sole traders who enjoy consumer protection under Polish law (natural persons concluding a contract directly related to their business activity that is not of a professional nature for them) are protected by the mandatory provisions of law; any provision of these Terms that conflicts with those provisions does not bind them.
1.4. These Terms form part of every contract concluded with the Client. In case of discrepancies, the contract prevails, then the offer, and then these Terms.
1.5. Personal data processing is described in the Privacy Policy.
2. Services provided electronically
2.1. On the website we provide, free of charge: access to content (articles, descriptions of services and tools), the contact form and the self-assessment tools in the Diagnosis section.
2.2. The agreement to use content and self-assessment tools is concluded when you open the page and ends when you leave it. The agreement for handling the contact form is concluded when you submit it and ends when we reply.
2.3. All you need to use the website is a device with internet access and an up-to-date web browser. The form and self-assessment tools require JavaScript, and submitting the form requires an email address.
2.4. Providing unlawful content is prohibited, including sending malware or third-party data without a legal basis through the form.
2.5. Results of the self-assessment tools are indicative only. They are not legal advice, an audit or an assessment of your systems.
2.6. Using the internet involves common risks such as malware and phishing. We never ask for passwords or payment details through the website.
2.7. Complaints about the website can be sent to kontakt@cyberforge.agency. We handle them within 14 days of receipt.
3. Contract formation
3.1. A contract is concluded by accepting a commercial offer in documentary form (e.g. by email) or by signing a contract — in writing, electronically (qualified electronic signature) or through a document-signing platform.
3.2. The scope, schedule, fee and payment terms are set out in the offer or the contract (e.g. Annex 1).
3.3. The contract takes effect when it is signed or the offer is accepted.
4. Fees and payments
4.1. Prices are quoted in Polish zloty as net amounts, plus VAT at the applicable rate, unless the offer states otherwise.
4.2. Unless the offer states otherwise, the fee is payable in two parts: 50% after the contract is concluded and 50% after the final deliverables are handed over (e.g. technical documentation or the final report). Each part is payable within 14 days of the invoice date.
4.3. Where required by law, invoices are issued in the Polish National e-Invoicing System (KSeF), and a copy is sent to the Client’s email address.
4.4. In case of late payment, statutory interest for late payment in commercial transactions and compensation for recovery costs apply, in accordance with the Polish Act on Counteracting Excessive Delays in Commercial Transactions. For consumers and sole traders with consumer protection, statutory interest for late payment applies.
5. Liability
5.1. The Provider’s liability for loss of or damage to the Client’s data is limited to the net fee under the contract in connection with which the damage occurred. This limitation does not apply to damage caused intentionally or to contracts with consumers and sole traders with consumer protection.
5.2. The Provider is not liable for damage resulting from:
- a) lack of access to systems or information that the Client did not provide,
- b) acts of third parties for which the Provider is not responsible, including attacks on the Client’s systems unrelated to the work performed,
- c) the Client not implementing the Provider’s recommendations,
- d) force majeure (e.g. war, natural disasters, large-scale cyberattacks, decisions of public authorities).
5.3. The Client is responsible for the accuracy of the information provided and for granting access to systems to the agreed extent.
5.4. Our services reduce risk but do not guarantee the absence of incidents or regulatory compliance. We cover the technical layer; full compliance also requires organisational and legal measures on the Client’s side and does not replace legal advice or a formal audit.
6. Withdrawal and termination
6.1. A business may withdraw from the contract by mutual agreement or with immediate effect if the other party seriously breaches the contract.
6.2. Either party may terminate the contract with 14 days’ notice in documentary form (e.g. by email). The Provider is entitled to payment for work performed up to the termination date.
6.3. A consumer or sole trader with consumer protection who concluded the contract at a distance or off-premises may withdraw within 14 days of its conclusion without giving reasons, e.g. by sending a statement by email. If, at their express request, we started the service before that period ended, they pay for the services provided up to the withdrawal. The right of withdrawal does not apply once the service has been fully performed with their express consent, after they were informed that they would lose this right upon full performance.
7. Complaints
7.1. Complaints about the services should be sent to kontakt@cyberforge.agency within 14 days of the service being performed or the deliverables being handed over, with a description of the issue. This period does not limit the statutory rights of consumers and sole traders with consumer protection.
7.2. We handle complaints within 14 days of receipt.
7.3. If a complaint is accepted, the Provider makes corrections free of charge within 7 days or within another period agreed with the Client.
7.4. Consumers may use out-of-court dispute resolution, e.g. the help of a municipal or district consumer ombudsman in Poland.
8. Final provisions
8.1. Amendments to a contract require at least documentary form (e.g. email), unless the contract states otherwise.
8.2. Contracts are governed by Polish law. Matters not regulated here are governed by the Polish Civil Code and other applicable acts.
8.3. Disputes with businesses are resolved by the court competent for the Provider’s registered office. Disputes with consumers and sole traders with consumer protection are resolved by the court competent under the general rules.
8.4. These Terms may be amended; the current version is always available at cyberforge.agency. Amendments do not affect contracts already concluded, unless the parties agree otherwise.
8.5. Accepting a commercial offer or signing a contract means accepting these Terms.
